Terms of Service

1. Acceptance of Terms

By accessing or using the Artin SmartAgent platform ("Platform"), including all associated services (Smart Hunter, ExpoSmart, RealtySmart, ClinicSmart, TravelSmart), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Description of Services

Artin SmartAgent provides AI-powered business automation tools, including but not limited to:

• Smart Hunter: AI-powered sales research, cold email generation, intent signal monitoring, and CRM data enrichment
• ExpoSmart: AI-driven exhibition lead capture and engagement
• RealtySmart: Real estate lead qualification via WhatsApp AI
• ClinicSmart: Medical clinic appointment scheduling and patient engagement
• TravelSmart: Tourism and travel agency customer service automation

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• One account per business entity; sharing accounts is prohibited
• You must be at least 18 years old and have the authority to bind your organization
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Plans & Payments

4.1 Billing

• Subscription plans are billed monthly or annually as selected
• All prices are in USD unless otherwise specified (Expo plans may be in AED)
• Payments are processed securely through Stripe
• Failed payments may result in service suspension after a 7-day grace period

4.2 Credits

• Smart Hunter plans include a monthly credit allocation
• Unused credits do NOT roll over to the next billing period
• Credit costs per feature: Research (1), Cold Email (3), Signal Scan (2), CRM Enrichment (2 per 10 records)

4.3 Refunds & Cancellation

• 30-day money-back guarantee on all paid plans
• Cancel anytime from your dashboard — no cancellation fees
• Cancellation takes effect at the end of the current billing period
• No prorated refunds for partial months after the 30-day guarantee period

5. Acceptable Use

You agree NOT to use the Platform to:

• Violate any applicable laws, regulations, or third-party rights
• Send spam, unsolicited commercial messages, or phishing emails
• Scrape data in violation of website terms of service
• Attempt to access other tenants' data or bypass security measures
• Use the AI to generate illegal, harmful, or misleading content
• Resell or sublicense the Platform without an Enterprise agreement
• Overload the system with automated requests beyond your plan limits

6. Data Ownership & AI Output

• Your Data: You retain full ownership of all data you input into the Platform
• AI Outputs: Research results, generated emails, and enriched data produced by our AI are owned by you
• Our Platform: The Platform, algorithms, source code, and design remain the intellectual property of Artin SmartAgent / AMHR
• Accuracy: AI-generated outputs are provided "as-is" — we strive for 85-95% accuracy but do not guarantee perfection

7. Multi-Tenant Data Isolation

Our Platform uses PostgreSQL Row-Level Security (RLS) to ensure complete data isolation between tenants. No tenant can access, view, or modify another tenant's data. Super-admin access is restricted to authorized AMHR personnel for support and monitoring purposes only.

8. Service Availability

• We target 99.9% uptime for Enterprise plans
• Scheduled maintenance will be communicated 48 hours in advance
• We are not liable for downtime caused by third-party services (Gemini AI, Stripe, hosting providers)
• AI processing times may vary based on query complexity and system load

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIN SMARTAGENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Artin SmartAgent, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users via email at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance.
